Phelps must pursue Marino as he flees down alleyways and attempts to escape. If Phelps can get a clear line of sight, it is possible to arrest Marino. However, due to the twists and turns throughout the chase, it usually ends with a shootout between Phelps and Marino, which in turn results in Marino's death, unless disarmed, in which case he is arrested.
The way that leads to the shootout is to follow him through an alley, left, up a pipe, across the roof to the right, up a ladder. Once he has climbed the ladder, there is no way to arrest him and he will run over a bridge and take cover in the roof.
Here is one way to arrest Marino; start running as soon as the opening cutscene ends. As soon as you reach the front of the alley, aim and fire at Marino's back before he turns the corner. As soon as he's hit, immediately go back to running. Run behind the two parked cars and then go up the drainpipe. As soon as you reach the roof keep your sight on Marino as he climbs the ladder to fire a warning shot.
- The chase is one of the more challenging in the game, owing to the fact it's easy for Phelps to get "hung up" on debris in the narrow alleyway at the start, giving the suspect time to get away.
